*REBUTTAL TO MEDIA REPORTS ON RETIRED ARMY OFFICIALS ILLEGAL DETENTION AND MANHANDLING BY SHO POLICE STATION BAKSHI NAGAR.*
Jammu 30.01.2025
The recent reports quoted by print and electronic media regarding 3rd degree torture and manhandling of retired army officials Suresh Kumar and Chander Shekher both real brother by SHO Bakshi Nagar are *strongly rebutted* by Jammu Police which are entirely misleading and factually incorrect.
On the intervening night of 13 January (Lohri Festival) while performing Patrolling duty, SHO Bakshi Nagar, when reached near Arya Samaj Mandir, Bakshi Nagar found three/four persons had parked their Vehicle *JK 17 8314* in the mid of road and were fighting with each other using aggressive abusive language in Bakshi Nagar Bazar which is also a prominent residential area.
When SHO stopped near their vehicle and requested not to create any hue and cry and further to remove their vehicle from road, accused Chander Shekhar and Subash Kumar started misbehaving with SHO. SHO showing patience tried to pacify the issue but the said Suresh Kumar and Chander Shekhar *attacked the police party* injuring SPO Anil Sharma and SPO Jai Krishan. All this incidence has been captured in a nearby CCTV installed. Investigation officer has also collected the CCTV footage of their misbehaving and attack on police party and forms part of important evidence. Police have also recorded this incident in their mobile phone cameras which is also part of evidence.
SPO Anil Sharma and SPO Jai Krishan were shifted to GMC in injured condition for treatment and the said accused persons were arrested after their medical from GMC, Jammu, at *0100 Hrs* after the registration of FIR 03/2025 of PS Bakshi Nagar u/s 132, 285, 307(3)(5) BNS following Hon’ble Supreme Court guideline in DK Basu case. No body is above law and their arrest cannot term as illegal detention.
Pertinent to mention here, that section *160 BNS* was inadvertently added due to clerical mistake for Affray (*Sec 160 IPC*). The same was corrected in the very first stage of investigation and section 194 BNS was added.
Whole of Police station including lockup and premises are under CCTV surveillance and no physical torture or 3rd degree was done to accused persons. Their family members visited police station Bakshi Nagar next morning and were allowed to meet the accused persons.
Their Medical was got conducted from Government medical college Jammu who *opined independently* without any influence and on the next day their remand was sought from *Hon’ble court with in 24 Hrs*. Hon’ble court granted Judicial custody w.e.f. 14.01.25 to 17.01.25 and were lodged in Amphalla Jail on 15.01.2025.Hon’ble court also *granted bail to the accused persons in the instant case on 15.01.2025*.
SHO Bakshi Nagar Azad Ahmad Manhas is a professional police officer decorated with *two President’s Medal for Gallantry* and *two Jammu Kashmir Police Gallantry medal* ,DG Disc and further recommended for *Shaurya Chakra Gallantry medal*. He has served in *anti-terrorist operations* five years in valley and five years in Jammu division and known for his bravery and extraordinary courage.
When the matter was brought in the notice of senior officers by respected members of Jammu and Kashmir Ex service league and others , immediately incident report was sought from immediate supervisory officer and explanation of SHO Bakshi Nagar was also sought in this regard. Taking cognisance an enquiry has also been initiated to be conducted by SP Rural.
