HC asks Centre, CBSE, DU to file reply on plea allowing transgenders to change name, gender in educational records

New Delhi, Jan 14 The Delhi High Court on Thursday asked the Central government and others to file a reply in case, they want to, otherwise no accommodation will be given to file the reply in a plea challenging the Transgender Persons Act. A division bench of Chief Justice D.N. Patel and Justice Jyoti Singh said, “If the reply is not filed, later cost will be applied for filing reply in this matter.” The petition has been filed by Aarav Singh seeking direction to the Central Board of Secondary Education (CBSE) and Delhi University (DU) to make provision helping and allowing transgenders to change their gender from male to female in educational records. The petition has further challenged the guidelines issued by the Centre, DU and the CBSE with regards to the change in name and gender of students. The plea has alleged that the Department of Publication requires a person to undergo Sex Reassignment Surgery before the change in gender. Hence, the bench allowed time to file reply to the respondents on a strict condition of applying cost if they request filing of reply at later stage. The matter will be heard next on February 12.
