Implement SC verdict on transgenders, HC tells govt

Reservation or affirmative action was one of the major demands of Transgenders from very long time and in the state of Jammu and Kashmir this community is facing lot of hardship, forcing them to do petty works like collecting money by adopting different ways.
Although this transgender community several times raised their voice in order to enter the employment and education sector, but they were deprived due to various flaws in the right to reservation. Transgender persons have historically faced discrimination in many areas, including access to education, employment, health care and housing.
After the Lok Sabha passed the bill stating that all public and private establishments are prohibited from discriminating against a transgender person in employment matters, including recruitment and promotion. If an establishment has more than 100 persons, a designated person will deal with complaints in relation to the Bill.
Recently, the J&K High Court has directed the state government to strictly implement the judgment of the Supreme Court about the rights of the transgenders in Jammu and Kashmir. These directions were passed by a division bench headed by Chief Justice Gita Mittal and the court also directed the state government to submit status report in this regard within four weeks.
The direction came after the petitioners had approached the court for the protection of constitutional rights of transgenders in the state and prayed that the state government be directed to implement the judgment of the apex court passed in National Legal Services Authority Vs Union of India.
They further sought directions to the government for determining the exact number of transgenders in the state besides a guaranteed quality life in terms of political, social and economic standards so that no transgender is subjected to any form of discrimination, injustice or violence.
Talking to Young Bites correspondent Social activist Rajeev Sharma said that transgender people are forced to live a life of penury and social exclusion. Though transgender communities have existed for centuries, they were kept out of historical accounts and ignored by the academia.
Welcoming the recent direction of division bench he further added that these direction will certainly a right step towards removing the social stigma, thereby giving them right to live and work with dignity.
