Tehsildar Udhampur initiates contempt against resident of village Sui

Tehsildar Udhampur sitting in a judicial proceeding directed SHO Udhampur to arrest Kaka Ram, a resident of village Sui in Udhampur, and present before Court to initiates contempt proceeding for making a contrary statement on the working of the court in Media.
Tehsildar Udhampur with the powers of Assistant Collector 1st Class initiated actions against the contempt U/S 480 CrPC read with 228 RPC for insulting the court camp Sui by giving contrary statement in media few days before.
However, the court of Tehsildar Udhampur in compliance with the order of Hon’ble J&K Special Tribunal Jammu on file No. STJ/216/2017 dated:28-08-2017 in a case titled Ram Krishan & Ors V/s Bishan Dass & Ors residents of village Sui and Rathian respectively organized a camp at village Sui on 18-11-2017 to ascertain the possession on ground and status of cultivation.
Whereas, the court recorded the statements of the respectable, village headman and host of a prominent resident with regard to the possession of ground and status of cultivation which was then and there reduced to writing.
The statement of the accused Kaka Ram S/o Late Premu R/o village Sui Tehsil & district Udhampur has also been recorded without any coercion and force along with his brother and mother. “The contrary statement on the working of this court in Media amounts to the contempt which is likely to be taken into the consideration and cognizance within the parameters of law”, order said.
The order of Tehsildar Udhampur read as, “ the order in the instant case for investigating the matter as is issued by Hon’ble J&K Special Tribunal Jammu on file No. STJ/216/2017 dated: 28-08-2017 involves the application of 28-A of the Jammu & Kashmir Agrarian Reforms Act, 1976 and the court of undersigned is also vested with powers to initiate contempt proceedings under section 480 CrPC read with 228 RPC and by virtue of section 18 & 20 of the Jammu and Kashmir Reforms Act, 1976.”
It further read as, “This court in exercise of the powers vested in me under section 480 Cr.PC read with 228 RPC and by virtue of section 18 & 20 of the Jammu and Kashmir Agrarian Reforms Act, 1976. Tehsildar Udhampur with the powers Assistant Collector 1st Class authorize the Station House Officer Udhampur to arrest the accused and present him before this court on 11 of Dec, 2017 so that the subsequent proceedings U/s 481(1) and (2) of J&K Criminal Procedure are initiated according.”
